Best Wishes Sean

TSN is reporting Sean Avery has a lacerated spleen after the Daily News reported he had cardiac arrest last night. Sam Weinman confirms the spleen while refuting the hear attack. Keep up with his Rangers Report for the latest, as he is the fastest and best of the beat writers.

The Rangers are now confirming it as well; he is done for the year.

All too often we dwell on the games and forget that they are actually played by people. Sean was demonized and lionized by various groups of fans but now everyone should just hope he is ok and wish him a speedy recovery.

So long Albert.

@

Lock up the *ssholes

A favorite reader, ABD, writes in:

Those people thought their God would protect them. In fact, they believed their God spoke to them and guided them through the maze of evil that the non-believers wove around them. Instead, as their numbers grew and grew, as resources dwindled, the people were frightened their God had deserted them.

Tell me what religious freedom is. Tell me what freedom is. Forget the religious part. Freedom is "exemption or liberation from the control of some other person or some arbitrary power ; liberty; independence. Exemptions from arbitrary restrictions on a specified civil right." (Webster's New World, 4th ed.)

I still do not know what freedom is. I think it is a concept that doesn't really exist in the purest sense of the definition. It can't. The mere quality of being in a physical state, of our awareness being married to our physical self denies us freedom. And from there, from the moment of birth, the concept of freedom is really elusive. I think you are only truly free when you accept that you are not.

And what defines a persons 'right' to anything? It is all arbitrary. People are guided by selfish, self-sustaining motives. There is nothing religious about religion. It may as well be a form of government as it functions by all the same principles and can be as destructive and confining to its people. I think religious freedom is an oxymoron. It's like saying you have the freedom to not be free. But since you are already not free, it's not really a choice in which case the government shouldn't make laws protecting something that doesn't exist. And then we could just arrest people for being assholes.

Every so often someone I know bisects the world in a way that makes me say, wow, let's extend that thought to everything. What if we reduced the moral basis for law and instead instituted penalties for various degrees of assholeness?

First, we'd see a return to civil society. People would be polite and respectful of one another, for fear of being prosecuted by their peers. Jury trials would be more effective, as determining if someone is an asshole or not is easily proven within a few days on the stand.

It doesn't matter how good a lawyer you have if the principal criterion on the stand is not the facts, but your attitude.

We'd end up with a kinder, gentler society, admittedly with a lot more people (from all walks of life) either in prison or attending charm school, or both.

So, this leads me up to two pieces of news of today:

Hans Reiser has been convicted of first degree murder, and faces 25 years to life in prison.

I found most of the circumstantial evidence against him tenuous at best, as I wrote when he first took the stand, but there was enough of it by the end for me to think second degree murder a likely outcome. There did not seem to be any evidence of premeditation, indeed, purchasing the books he purchased a week after his wife's disappearance suggested not only innocence, but lack of pre-mediation. He may have hated her, but he hadn't planned out killing her.

The internet thought differently, a poll of wired readers showed 62% not guilty. This reminds me
of a study done years ago (don't know the name of it) where trials were recreated for new juries by using purely recorded audio, and via using transcripts only.

In this case the transcript readers voted not guilty, those that got to see the legal theatrics and the man in person voted the maximum penalty.

If Reiser hadn't taken the stand and proved himself an asshole of the first degree, perhaps he'd have got off more lightly. I'm glad he took the stand and had a chance to defend himself in his own words, in his own internal framework. Sometimes the dialog became surreal, yet eloquent, with a hard edge of truth that rang outside the narrowness of the case itself:

Attorney: "What, if anything, might you have done that could have caused Nina to disappear?"

Reiser: "I opened the door."

Reiser: "Only the lawyers win in divorces."

Reiser: "... before the divorce, I believed very much in the legal system, and I thought ours was superior to Russia's."

Reiser: "I don't think anybody would conduct themselves in a menacing manner in front of the police."

Reiser recounted an incident in which Nina saw a "wonderful old man shaped like a bowling ball, and she walked up to him and stroked him on the tummy and said, 'There's nothing but muscle here,' and he just beamed, and he just loved it. And that was Nina."

Reiser: "Marriage is altruistic in the financial sense. It's a lot cheaper to hire a housekeeper."

Paul Hora asks about "where the file system was".

Reiser: "That's like asking where cyberspace is."

Reiser: "I don't think she really appreciated it when the cat chose to join me on the couch" .

Reiser: "Would you like me to tell you what Shelly Gordon said to me in a way that would make it hard for the prosecution to object?"

Did Reiser had any problems with Nina's new boyfriend, Anthony Zografos?

No, Reiser said, because Zografos "isn't into cannibalism."

Reiser: "She has the most beautiful voice. She has the most beautiful voice of anyone I have ever met. To this day."

Reiser: "She has more people skills than any lawyers in this county."

Reiser:"Most romances end up being a waste of time, if you look at them with excessive logical analysis. I prefer to not look at romance logically and analytically."

Reiser: "The problem here is that you think you can smile at me and I will forget. Those who anger slowly, cool slowly."

Reiser: "I don't have a great deal of desire to give the government all my possessions. Not my underwear, not my car and definitely not my children."

Hora asked if Reiser "intentionally decreased the value of the revenue" of Namesys as part of the divorce proceedings to keep money away from Nina, and Reiser said, "I would have liked to have enough revenue to be able to decrease it."

"There's no possibility that I have not touched that post in the last 30 years of living in that house."

"How smart are you?" Hora asked.

"Not very," Reiser said.

"Are you a genius?"

"No, but I can fake it."

"What's your IQ?"

"I haven't taken an IQ test."

"You claim to be world-famous, right?"

Reiser said he's had the occasion to write that on papers, yes.

Hora commented that he'd never heard of Reiser's file system before. He asked if the reason Reiser has described himself as a world-famous, internationally-renowned scientist was because he believed he was such a person. Reiser said yes.

"Still do?" Hora asked.

"I think the word 'renowned' is no longer appropriate," Reiser said.

I understand, now, in the adversarial justice system America has, why lawyers counsel not taking the stand in your own defense.

Reiser will appeal, but we won't be hearing from him much, although I imagine he'll become another Birdman of Alcatraz. Given good behavior in prison, Reiser will be able to access a computer again, although it will probably be running Windows.

Given the DoD connection, I doubt that his hard drives will ever be heard from again.

I don't think we'll ever know if he was truly guilty of anything more than being an asshole.

In other news, the first piece of hard evidence towards abuse at the FLDS settlement has been announced to the press. (I note that the individuals involved have been banned from talking to the press). Apparently 31 of the 54 girls between the ages of 14 and 17 have been or were pregnant.

I want to make clear that I don't approve of old men sleeping with 14 year olds, OK? I do note that that that was legal under Texas law until 2006. I do note that spread of the figures immediately suspicious, and biased toward the prosecution: Why not publish numbers for 14,15 (clearly illegal under current law), 16 (maybe), 17 (not)...

As a blogger, and a person, my empathy always goes towards the underdogs. In this case my immediate view was to respect religious tolerance. Anytime I see police tanks roll up to a settlement (and I refuse to call the place a compound, the pictures show otherwise), my head fills up with scenes from Warsaw in 1939, one place among many, where people were different enough to be enslaved and gassed.

My thinking here has evolved somewhat, based on new evidence and research, but its too much to go into in one posting.

The thing is: I believe in the law; it's all we have that keeps us even mildly civil to each other.

And I freely confess that I may have been an asshole.

Horford is Real (as are the Hawks)

Yes, I said Horford does not deserve to be this year's Rookie of the Year. By now, everyone pretty much agrees with this.

But that said: this Horford kid...he's got it. You know..."it"! He has it! That thing that elevates a player over others with similar skill and size. That thing that makes players become fan favourites, and that thing that draws the best out of his team-mates. That thing that let's the opposition know you don't take no shit...that thing that helps win games.

Horford, like Durant, has got it...and all of a sudden the Hawks seem to have a starting five with great potential. No, they probably won't win this series against Boston, but they have shown that on some nights they can match it with the best of the best. Give this team another year or so, and they could go places. Let's have a look at the starting 5.

PG - Mike Bibby
If he has an injury free pre-season and can grab some time to fully mesh with his new team-mates, next year could be a great one for the Hawks. He's still young enough to contribute his best to this team for a few seasons.

SG - Joe Johnson
The guy simply can make buckets. Some nights he may go cold, but when he is hot you can ride him for an easy W. Hand in the face? Doesn't matter. Fade-away? Money. When he is on, he can shoot with the best of them. On his off nights, that's when you need your post presence.

SF - Marvin Williams
Sure, he was picked over CP3. But that was hardly his fault, was it? The kid is getting better all the time. Possesing a solid mid-range jumper, nice finishing around the rim and a good Free Throw percentage, Williams is finally showing us what he can do. Not a terrible player to have there at the SF glueing things together. He definetely has another gear to climb, though.

PF - Josh Smith
OK, this guy is my favourite player. But looking past that, what does he bring to the table? He is probably the most athletically gifted player in the league, bar Lebron. Coupled with a natural defensive instinct, you better watch out when you are attempting to finish a fast break, or even in the half-court. Smith will most likely always be hovering. His shooting is a weakness, and incredibly streaky. It does seem however, he posseses enough of a base to improve this into a strength. Much practice will be needed in this area. Add this to his game, and he will be an All-Star, of that there is no doubt. He already fills up the stats sheet...with more PPG added he would be an incredibly useful player to build around.

C - Al Horford
The rather small line-up is completed by Horford. There is a reason he was part of two NCAA championship winning teams. He plays with heart, and confidence. His energy is infectouos. It seems that he will be towards the top of the rebounds per game list for years to come. Obviously he needs to work on his offensive game and lift his FG%. He may struggle at times around the rim, being smaller than your average centre, but must work to make up for this and get easy buckets on the fast break. It also seems he has a few moves that work from time to time which should be developed, as well as a mid-range jumper.

This young starting line-up offers plenty of potential. Childress offers a good option off the bench, but otherwise depth is a weakness in this Atlanta team. A solid veteran or two wouldn't go astray. A genuine 7-footer is also needed, and I would recommend the Hawks do all they can to secure one in the upcoming draft. Complete all these items on the franchise-building check-list and the Hawks could go somewhere real soon...let's see how it pans out.

Riley Calls It Quits; Spoelstra Takes Over

Where were you the last time you heard this news: Pat Riley is retiring as coach. And the time before that? And the time before that?

Well, Heat fans - and Knick fans - should be able to remember those moments. I still remember the surreal moment we landed Pat Riley here in South Florida. The fortune of this franchise changed instantly.

And now, Riley is once again leaving the bench and heading upstairs. In 2003, four days before the start of the regular season a change was made. Back then it was in favor of Stan Van Gundy, who is currently leading his young Magic team through the playoffs. Today the change is being made for a young Erik Spoelstra, a virtual unknown outside of these parts. And really only known to those of us who are hard core fans of the Heat.

Spoelstra, at 37, is now the youngest coach in the NBA - 69 days the junior to Lawrence Frank. He has been a fixture on the Heat's bench since 2003, mostly working with players on their jump shooting techniques and scouting. His coaching presence has been felt as even Dwyane Wade has paid complements to Spoelstra for helping him grown and develop his game.

Earlier in the season, Riley had stated he was committed to coaching for the remainder of his contract. A big factor in the change of heart may have come from Shaq - who was with the team at the time Riley made that statement but has now been dealt to Phoenix for Shawn Marion and Marcus Banks. Most obviously, this is the reason why Stan Van Gundy got cold feet back in 2006 and why Riley stepped in - due to Shaq's pressing.

Now, Riley is free to be simply the team president and GM. Naming Spoelstra to this position has been a while in the making. Other candidates were Ron Rothstein and even Mike Fratello - and I would suggest Jeff Van Gundy - but the time is now to rebuild so it might as well go all the way.

Maybe a big influence, too, in Riley's decision was his hall of fame induction. What more does he have to prove? He won a championship in 2006 and without all the injuries and locker room drama, and some questionable offseason decisions, who knows if another one wasn't in the stars. But that isn't for him to worry about - at least not on the court anyway. That is Erik Spoelstra's job - and let's hope it is not like it was for Stan Van Gundy.

Discuss the Heat's coaching move with us here. Report: Clemens Had 10 Year Affair

According to this morning's Daily News edition, Roger Clemens held a ten year affair with then 15 year-old country singer Mindy McCready. Clemens was 28, married and a father at the time of the alleged affair.

Is this the worst calendar year of all time for a celebrity/entertainer? Rocket's getting into hall of shame territory:

Roger Clemens carried on a decade-long affair with country star Mindy McCready, a romance that began when McCready was a 15-year-old aspiring singer performing in a karaoke bar and Clemens was a 28-year-old Red Sox ace and married father of two, several sources have told the Daily News.

The revelations could torpedo claims of an unsullied character that are central to the defamation suit Clemens filed Jan. 6 against his former personal trainer Brian McNamee. Vivid details of the affair could surface in several media projects that McCready is involved with - including a documentary that begins filming today in Nashville, a new album and a reality show.

...Contacted by the Daily News Sunday through his lawyer Rusty Hardin, Clemens confirmed a long-term relationship but denied that it was of a sexual nature.

“He flatly denies having had any kind of an inappropriate relationship with her,” Hardin said. “He’s considered her a close family friend. ... He has never had a sexual relationship with her.”

What's the statute of limitations on statutory rape, I wonder.

4/27 Heard in the Waiting Room

Louis Lombardi (from '24') was apparently upset at the Palm Beach Film Festival at the way the organizers ran the festival, and made a crack at Tristan Rogers' fame. NS2 is happening. I thought Steve's reason why he isn't doing it this time was very interesting. He said he didn't want to do it because Bob and Jill weren't involved this time and he didn't want another producer or writers that didn't know the Jason character fooling around with the character.
He also told about the Coleman/Patrick/Spinelli scenes at Jake's. They sound hysterical. Those will air 5/12 and 5/13.(source)

:: Could be Complete Crap Fiction::
Daytime Dish:
4/26
Patrick sticks his foot in his mouth.

Scrubs?? Is it a long break up??
I don't think so but can't say for sure. Don't care about them so I don't ask.
I only like mob stuff.
Hope this info helped a bit! (source of the above)

Robin does ask for space from patrick, I don't know if you consider that breaking up, but she does try to avoid both him and her mom. Patrick becomes worried when she misses work.
TY. Is this off screen? Her missisng work. tia
Part of it is onscreen. She does have scenes with mac and kelly.
TY. Great is it another missed opportunity for them? I really want Patrick to be there for the important stuff. He already missed the first sonogram. Please let him be there when she hears the baby's heart beat for the first time.
No it's not a missed opportunity. It is something to do with her meds.
Does Patrick have scenes with Liz where she tells him to be patient, and he says if he waits he might lose Robin forever?
I didn't spoil that, but yes he does.
Anon I am really hoping you are right and Robin misses work because of her meds. I hope that means she and Mac talk about it. Also I am guessing that eventually there is bigger trouble with them and that is when Robin gives into Patrick's pursuit.
She doesn't miss work because of her meds. She misses work because she needs a break and is trying to avoid patrick, but she does have scenes with kelly regarding her meds.
Does Patrick take Liz advice on being patient or does he decide to fight for her?
I answered this in the last thread. I didn't spoil this, but yes does talk to liz and he tells her if he gives Robin time it means he will lose her, and he does fight.
Thank you so much, something to look forward to yay!! Do you happen to know how he fights for her?
I can't tell you anything right now, but he is going to grow up more than people/viewers expect of him. That's all the info I have. If I have more info I' share.

I am dropping one spoiler off and only one. Jake's birthday party freaks Patrick out and he goes off on Robin for draggin him there. That is the last straw for her and she tells him he needs to decide what he wants and she needs space until he does.

4/27
From FSA on SD:
SERIOUSLY, all I can say is DONT give up. A month from now, I TOTALLY believe the Scrubs fanbase will be whistling a different tune!
I wish I had you enthusiasm but I don't but good luck.
Let me put it this way, IF I was talking out of my ass, I wouldn't be THIS optimistic!
Cool, so you have heard something? Hmmm, intriguing.
Okay, here is what I will say and cuss me out or whatever:
Lets say right now where Scrubs are is at 0 degrees, well by the end of sweeps they do a COMPLETE 180 and I know most everyone's heads will be spinning. It is a GOOD thing and for me to say anymore would cause mahem... Please just KNOW it is good and I will share more when I get complete confirmation. NOTHING is worse than having egg all over ones face!
FSA is this from your insider friend?
Yes.
I could NO longer just sit on my hands and NOT let my fellow Scrubs fans know that good things ARE coming. I am reading post after post in the IL of such horrible scoops (well to some, not all) that I just wanted to say w/ fact that hope is NOT lost by a LONG shot!
FSA they said something happens with scrubs during sweeps?
Yes.
FSA can you give us a hint.
IF I could you KNOW I would! I hate being vague, but before I have ALL the facts, and KNOW that what I KNOW is 110% legit, I will not share. It is better to not share until I have all details for you all!
I'd prefer you not to spill until you are 100% sure anyway. But thanks for the heads up.
You're welcome. You know how I loathe the IL of 99.9% bullshit. So I find not sharing until I am 110% sure is better than sharing something that later I find out is false, esp as an RP cause then people are going to be like, SHE LIES, SHE LIES. Dont want that kinda shit on my back here. Giants missed the boat on Barrett, picked Jonathan Goff

Wonder: "Goff is a good solid inside plugging LB but he belongs in a 3-4, not the Giants 4-3. To have a chance at Barrett at that spot and pass him up is terrible, mindless."

Separately Wonder is in mourning for not getting QB Josh Johnson (taken two spots ahead of the Jets). Re QB Ainge, "just what we need, another weak-armed QB."

Though fans of the Steelers may be leery of a Bruin selection (who can forget the disaster that was Danny Farmer), Mr. Davis is a high-energy, non-stop impact player. A leader on the Bruins' defense (the same group that limited USC to seven points in the 2006 game), his performance in the Las Vegas Bowl was amazing for its intensity from beginning to end.

Mike Mayock of the NFL Network projects Mr. Davis as an outside linebacker (think a faster, stronger Joey Porter), and Ourlads Scouting Service agrees saying that he "[c]overs a lot of ground in pursuit . . . [g]ood chase speed and flashes a burst in the pass rush . . . [d]isruptive in his play."

While he has a great deal to learn about playing the linebacker position this is a player who can contribute immediately on special teams.

Steelers Draft Offensive

The Steelers drafted Rashard Mendenhall, a running back from Illinois with the 23rd overall pick. Mendenhall is the first running back since Tim Worley (1989) that Steelers used a number one pick on. Check out Kevin Colbert and Mike Tomlin's comments on the Steelers official website.

The next Worley?

In round two they picked up a big target for Ben, which we all knew he wanted, when the chose Limas Sweed (6' 4")from Texas. As of right now I like the picks, the WR core was rather thin and a tall guy should help. Willie Parker and Rashard Mendenhall should hopefully give us a diverse two man tandem that will give defenses fits.

Having said that, I was hoping for o-line and LB depth. Country Music Marathon Leaders Passing Through the North End

I showed up at the marathon race course this morning about 7:45 and was able to get some photos of the leaders of the pack passing through the North End. While I missed the men's leaders heading out of Downtown and up Rosa Parks, I did catch them on the leg down Rosa Parks from MetroCenter to Bicentennial Mall.

Leaders of the field on the North End leg are Ketema Nigusse (14), Sylvester Chebii (17), Meshack Kosgei (1220), and Christopher Torotich (7). The marathon website shows no split or finish times for Matui, so I don't know if the Tennessean is wrong or I'm just not reading the live updates correctly.

The women's leaders (bib numbers F7 and F10) headed up Rosa Parks toward MetroCenter. The Tennessean's photo makes it obvious that Chebii won the marathon, but the live updates on the marathon website don't seem to be reporting his correct time. Am I misreading something? Are the live update times unofficial times?
